An editorial in today’s New York Times notes that
The right of habeas corpus is so central to the American legal system that it has its own clause in the Constitution: it cannot be suspended except “when in cases of rebellion or invasion the public safety may require it.”
Yup.
Of course, the right to keep and bear arms is so central to the American legal system that it has not just its own clause but its own Amendment, which is even more absolutist in affording no exceptions to the stipulation that the right “shall not be infringed.“
Pity The Times isn’t willing to grant law-abiding citizens as much constitutional protection as alleged enemy combatants. But then there’s a lot of that going around.

Margie, you’re right I do care very much about justice—here. I consider every single person in Richmond city my neighbor. These are the people I’ll look-out for if & when I can.
The last concern I have is whether or not a terror suspect in Guantanamo has their habeus corpus. I’m not saying they shouldn’t have this, I’m just saying I don’t give a hoot.
All rights are subject to limitations and rights and should be put in context .
If the Second Amendment is so clear cut, why is it so much debate about it. I am not against the ownership of guns. But if the second Amendment is so absolute then why are felons not allowed guns when they are released ? Secondly, a gun is a two edged sword(no pun intented.) There is a right to bear arms but guns can also be used in crimes.
Habeus Corpus is basically a piece of paper that in and of itself is not used in an armed robber. “People who are freed on Habeus Corpus may committ crimes
but the writ does not.“
It is also worth noting Habeus Corpus is embodied in the main Constitution not the amendments. This is because it was considered very central to justice.
And as Larry not caring about the issue, his right. It is a typical American attitude. Wave the flag, carry the cross, watch the July 4th parade and not even understand what the Constitution stands for or why.
Evidently I have missed a lot. You once cared very deeply about justice, Larry. Have you become cynical in my absence?
To Hell with Guantanamo. I do not care at all about this.
Lol! Thanks, Bill, it is nice to feel welcome. Been shutting the world out and writing lousy poetry on Myspace. This ruling got my attention!
Margie!! Is that you?
Where ya been?
I was just thinking about you and some of the other fomer regulars the other day.
Stay a while, wouldja?
This ruling restores my faith in the future of this nation. I feel like singing ‘America the Beautiful’!!! And you are right about gun control.
