I think the middle ground in the civil liberties argument is to give the authorities the tools they need but institute strong oversight.
One example Bart left out was the incredible tale of the former head of the FBI, J. Edgar Hoover. He ruled the roost for many decades, kept secret files, paranoid weirdo, reputed cross-dresser. Who was his oversight ? No one. He was at the top of the then heap and he ruled the FBI with an iron hand.
In theory, you keep the paranoia at bay by making sure there is oversight. Go ahead and investigate. Just keep records get authorization, and be subject to investigation yourself.
Yawn.
It would be nice if the national belt -tightening included less black helicoptors and more well-trained agents on the ground who know the difference between terrorists and environmentalists.
Here in Richmond, I am thankful to FBI agents who rooted out some of the corruption and white collar crime(Hedgepeth, Salomonsky).
BTW, I trust Palin’s intellect far more than NObama. She may not have the academic credentials, but that is not a minus. I would rather have a President from U.of Idaho than Harvard.

However, if we had a legislature and US Congress which were responsive to changing situations, then a law can always be changed to rectify the consequences.
